To the fullest extent permitted by applicable Philippine law, Joliph's total liability to you in connection with your use of the Platform — whether arising in contract, tort, negligence, or otherwise — shall not exceed the total amount deposited by you into your Joliph account in the 30-day period immediately preceding the event giving rise to the claim.
Joliph shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or in connection with your use of the Platform, even if Joliph has been advised of the possibility of such damages.
Joliph does not warrant that the Platform will be available at all times, free from errors, or free from viruses or other harmful components. Joliph reserves the right to suspend or discontinue the Platform or any part thereof at any time without prior notice.
Nothing in these Terms shall limit or exclude Joliph's liability for fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
Joliph reserves the right to suspend or permanently close your account at any time, with or without prior notice, if Joliph reasonably determines that:
Upon termination for cause, Joliph reserves the right to forfeit any account balance, including real-money funds and bonus funds, where such forfeiture is warranted by the nature of the breach. Where termination is not for cause, Joliph will return any verified real-money balance to you via your registered payment method within a reasonable period.
You may close your Joliph account at any time by contacting customer support. Account closure requests will be processed within 5 business days. Any pending withdrawals at the time of closure will be processed in the normal course.
These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.
In the event of a dispute between you and Joliph, you agree to first attempt to resolve the matter informally by contacting Joliph's customer support team. Joliph will endeavor to respond to all formal complaints within 10 business days.
If a dispute cannot be resolved informally, both parties agree to submit to the exclusive jurisdiction of the competent courts of the Philippines. Nothing in this clause shall prevent Joliph from seeking injunctive or other equitable relief in any court of competent jurisdiction.
Joliph reserves the right to amend, update, or replace these Terms at any time. When material changes are made, Joliph will notify registered players via email or a prominent notice on the Platform at least 7 days before the changes take effect, where practicable.
Your continued use of the Joliph Platform after the effective date of any amendment constitutes your acceptance of the revised Terms. If you do not agree to the amended Terms, you must cease using the Platform and close your account before the effective date of the changes.
